Contract Periods When Renting Your Property For Long Term Rental

Renting your property for eleven months or asking your rental tenant to sign an eleven month contract, does not make the contract or agreement a temporary agreement. It does not give you legal rights to give notice to your tenant after eleven months. Many landlords ask if they can have an eleven month contract with their tenant, thus allowing them to ask their tenant to leave after the eleven months has elapsed. They even inform us that their previous real estate agent or a current agent has informed them of this. This was something historically that many landlords and real estate agents used to try and create a temporary contract rather than a permanent residential contract, but unfortunately does not hold any legal value.
The property rental laws are quite simple and straight forward in Spain. If you rent your property for a period of less than ninety days, it is deemed as temporary period and a temporary rental contract. If you rent your property for longer than ninety days, it is then deemed as a long term rental contract and a residential contract. A permanent residence for the client and thus gives a a tenant up to a minimum of five years legally. Of course, there are stipulations within the finer details of the contract.
